Case Summary: 12-cv-2573
Plaintiff Jack R. Jordan, formerly an attorney at Sprint, filed this action against Defendants, Sprint Nextel Corp. and former CEO Gary Forsee, alleging retaliation because Plaintiff engaged in activities protected under the Sarbanes-Oxley Act of 2002.
Plaintiff was employed by Defendants in Sprint’s Corporate Secretary Group from January 13, 2003 through April 25, 2005 but was placed on administrative leave and then resigned. Plaintiff subsequently attempted to be reinstated, but Defendants refused to rehire him. Plaintiff filed three complaints with the Occupational Safety and Health Administration, all of which were dismissed. Plaintiff then initiated three proceedings before a Department of Labor Administrative Law Judge, one of which was removed to this federal court pursuant to Sarbanes-Oxley.
Defendants moved to dismiss the case, arguing that the claims in Plaintiff’s amended complaint are time-barred and not properly pled. This video shows the January 27, 2014 hearing on Defendant’s Motion to Dismiss.
