January 2025 – Mr. Morrison provided the following supplement to the above suggestion: “I have read the memo from the subcommittee and I agree that making the inquiry of the two groups of district courts should be helpful. I have a suggestion: make a similar inquiry of judges who have handled mass tort cases in MDL proceedings. These cases almost always involve state law claims, often involving state laws other than the law where the district court sits, generally with lawyers from many different districts who are not required to gain admission to the district court where the MDL is located. If there are no problems in those cases, that would be relevant to the subcommittee's deliberations.”
