Plaintiff Genevieve Williams brought an action against Defendant United States for injuries Plaintiff sustained from a fall while at the Navy Exchange convenience store in Tennessee. As Plaintiff was exiting the store, she slipped and fell in a wet substance on the floor. A clerk at the Navy Exchange attended to Plaintiff, and informed Plaintiff that prior to her fall, a man had come back to the store to return an item because it was broken and dripping liquid.
In this video, the Plaintiff and Defendant argue their points at a bench trial. Plaintiff alleges that the Government is liable under the Federal Torts Claim Act for the injuries she sustained from the fall. Defendant alleges that there is no clear evidence that the Navy Exchange knew or should have known that there was liquid on the floor because no one was aware of the spill at the time of Plaintiff’s fall. Plaintiff calls an employee of the Navy Exchange as a witness to testify about the photos and video of the security footage from the store. Defendant cross-examines this witness. Plaintiff’s counsel also calls Genevieve Williams as a witness to testify about her injuries and current health.
