Phil-Insul Corp v. Reward Wall Systems, Inc.

On February 2, 2011, plaintiff Phil-Insul Corp., doing business as IntegraSpec, filed a complaint for money damages and injunctive relief in the United States District Court for the Eastern District of Texas against defendants Reward Wall Systems, Inc., BuildBlock Building Systems, LLC, Nudura Corporation, Polyform A.G.P. Inc., and Amvic Corporation.  The complaint alleges that each defendant infringed upon a patent owned by plaintiff.  Defendants denied liability and asserted counterclaims.  On April 8, 2011, defendants filed an opposed motion to transfer venue to the District of Nebraska.  On November 22, 2011, defendants filed a joint motion for hearing on early claim construction.  Subsequently, on February 10, 2012, the United States District court for the Eastern District of Texas issued a memorandum & order, transferring the case to the United States District Court for the District of Nebraska.  On June 29, 2012, the Nebraska district court held a claim construction hearing (a “Markman hearing”).  On July 19, 2012, the court issued its memorandum and order regarding claim construction, construing the patent terms “adjacent,” “substantially the same dimension,” and “substantially planar ends.”
