Plaintiff, Collette Groenwald, brings an action against Defendant, the Commissioner of the Social Security Administration (SSA), alleging the denial of social security benefits. In this video, the Court hears arguments from both parties appealing a Motion to Remand based on new evidence. Plaintiff requests remand, explaining that the new evidence should be considered by the SSA because the evidence is “new and material” to the case. Defendant argues that the new evidence should not be subject to review because it is not “new and material.” The Court discusses the arguments of both parties and analyzes the case law used to support their arguments. The Court agrees with Plaintiff and remands the action to the SSA for further consideration.
