Case Summary: 11-cv-00047-JEG-TJS
This is an employment discrimination case - filed under both the federal and state civil rights acts - wherein the plaintiff claims that his employer and various members of management engaged in racial discrimination, or refused to alleviate discriminatory conditions, creating a work environment so hostile that he was forced to retire. Defendant alleges numerous racial slurs over his 19 years of employment at LaFarge, as well as threatening behavior by employees, shunning after his complaints led to another employee being forcibly retired, and unfair work assignments.

The Defendants' arguments are that either Plaintiff failed to allege sufficient facts to support a cause of action against the defendants or, even if there are sufficient facts and they are believed to be true, they do not constitute a violation of the laws alleged in the complaint.
