On March 25, 2002, a complaint was filed against defendant Royal Indemnity Company to recover monies owed under lease bonds. On October 12, 2006, after the lease bonds had been assigned to it, plaintiff CadleRock Joint Venture, LP filed an amended complaint seeking damages for breach of lease bonds, fraud, negligent misrepresentation, fraudulent inducement, and breach of the sale and servicing agreement.

A jury trial began on February 23, 2012. On March 15, 2012, the parties informed the court that they had reached a settlement. On March 22, 2012, the parties filed a stipulation of dismissal with prejudice relating to this case as well as two consolidated, related cases. On March 27, 2012, the court issued an order approving the stipulation.
