This case involves the attempt to collect a debt that was allegedly discharged in bankruptcy. On October 6, 2011, plaintiff Marvin Shane Blanchard filed a complaint for damages against defendants Dorsey, Thornton & Associates, LLC and Michael Thornton in the United States District Court for the Southern District of Iowa. The complaint alleges claims for violation of the Fair Debt Collection Practices Act, violation of the discharge injunction provision of the US Bankruptcy Code, violation of the Iowa Debt Collection Practices Act, and intrusion upon privacy. On March 29, 2012, plaintiff filed a motion for default judgment against defendants. On May 24, 2012, the court heard argument and presentation of testimonial and tangible evidence on plaintiff’s motion, which is presented in the video. The case is awaiting judgment on the motion.
