Acres v. Blue Lake Rancheria, et al

Subject Matter:
Last Updated:

Case Summary: 16-cv-05391-WHO

The case involves plaintiff seeking declaratory and injunctive relief against defendants, asserting that the tribal court lacked jurisdiction over him in an underlying contractual dispute in the Shiomoto case in Superior Court. Plaintiff alleges that individual court employees exceeded their authority during the pendency of the tribal action. An earlier defendants motion to dismiss in the Northern District of California was granted on August 10, 2016, to require that plaintiff exhaust his tribal remedies. The matter comes before the Northern District of California again, as plaintiff asserts that the bad faith exception should apply to this case because defendant allegedly misrepresented his legal relationship with the Blue Lake Rancheria Tribe to plaintiff in the underlying Tribal Court case, and in defendants declaration to the Northern District of California.
