Case Summary: 11-cv-80856
On July 27, 2011, plaintiff Amy Hackney filed a complaint for violation of 28 U.S.C. § 1875 in the United States District Court for the Southern District of Florida against defendant Jack Daubert, M.D., P.A. doing business as Florida Vision Institute. The complaint alleged that plaintiff was unlawfully terminated from her employment with defendant as a result of being summoned for jury duty. A jury trial was held from May 29, 2012 through June 1, 2012. The jury returned a verdict on June 1, 2012, finding that (1) plaintiff was not threatened with discharge because of her obligation to serve jury duty; and (2) plaintiff’s obligation to serve jury duty was not a substantial or motivating factor in her termination. The court entered judgment in favor of defendant.
